Independent Contractor Agreement (IN)
An independent contractor is a self employed individual who provides services to a client as a non-employee. Independent contractors typically invoice for their work and are responsible for paying tax on any compensation. Employers are not required to withhold tax for an independent contractor, although may be required to submit a 1099 form with the Internal Revenue Service (IRS).
It is recommended that you have a written agreement in place when engaging the services of an independent contractor to help avoid any potential misunderstandings. This particular agreement will allow you to set out, for example:
- The particular services provided by the contractor
- Compensation options either as a lump sum or interval of your choice
- Whether the contractor will invoice for their work and in which intervals
- Whether the contractor will be required to maintain insurance under the terms of the agreement and which types
